Combating late payment

The Office of Competition and Consumer Protection conducts proceedings regarding excessive delay in payment.

During the proceedings, UOKiK may inspect or request specific information and documents. The Office's powers in this respect apply not only to the entrepreneur against whom proceedings are being conducted or its creditors, but also to other entities, if they have the data relevant in the context of the proceedings. 

In the event of excessive delays within the meaning of Art. 13b of the Act on preventing excessive delays in commercial transactions, UOKiK may impose an administrative penalty. Its amount depends, among others, on the value of late payment and the period of delay.

According to this Act excessive delay occurs when - over the period of 3 consecutive months - the sum of the due and unpaid cash benefits paid by the entrepreneur amounts to at least 2 milion PLN.

In the case of proceedings initiated in 2020-2021, the above sum was at least 5 milion PLN.
