• LaLiga Santander and football matches by Robert Lewandowski in WP Pilot? Yes, but despite promises not all of them.
• The Netwizor company running its WP Pilot website via which you can watch TV online, including channels broadcasting sports games alive, suggested its customers that they would not miss any of the football matches.
• Now it is at risk of a fine of up to 10 percent of its turnover. 

“You can’t wait to watch Robert Lewandowski’s performance in FC Barcelona?” Get ready! Buy access to all channels of Eleven Sports in WP Pilot and don’t miss any of the LaLiga Santander football matches”, “Lewy in Spanish colours in WP Pilot! Don’t miss any match!” - this is how last year, among others, following the transfer of Robert Lewandowski to FC Barcelona, the Netwizor company promoted the service consisting in access to channels in which some football matches of the Spain Premier League were broadcast involving the performance of the Polish footballer in FC Barcelona. The promotional slogans appeared in social media, push notifications at WP Pilot websites, in mobile application and in online advertisements. Consumers who were interested in the game, purchased access to channels offered on WP Pilot website to find out in the next step that some football matches were not available. Following a soft call to the Netwizor company and conducting the preliminary investigation, President of the UOKiK, Tomasz Chróstny, has charged the company with violating the collective interests of consumers.

The Netwizor company promoted its offer with the slogans which might have been misleading for consumers. They might have concluded that if they had purchased packages containing Eleven Sports channels, they would have access to all football matches specified in WP Pilot advertisements and commercials guaranteed. Meanwhile the channels broadcast only half of the games which had not been communicated in the advertising messages.

“The information on broadcasting only 50% (that is, a half) of the football matches by Robert Lewandowski in the Spanish league was not placed in any informational materials inserted in links and advertisements and commercials available at wp.pl (...) Absence of this information in unfair marketing disinforming the package purchasers”. “I wanted to watch the FC Barcelona - Rayo match because Lewandowski was supposed to play the game (...) I would like to cancel my subscription and get PLN 15 back”, “In the package I have bought LaLiga was to be available (...) I want to have my money returned because I won’t even use it” - such complaints were submitted at the entrepreneur and UOKIK, similarly worded submissions were placed at the company’s Facebook profile: “Why do you mislead. No Eleven broadcasts all football matches by Lewandowski”.

-Access to specific sports events - broadcasts of football matches of a specific football league or performances of a specific footballer are of key importance for a lot of spectators which choosing an offer of an entrepreneur and taking a decision to buy its services. An advertisement using the context of specific football matches and participation of specific footballers may not omit important information. Consumers have a right to expect that advertising slogans are reliable and not misleading. In the case of WP Pilot offer, consumers could have expected that if they bought access to the Eleven Sports channels, they would not miss any football match - says Tomasz Chróstny, President of the UOKiK.

The proceedings against Netwizor may end up with a fine of maximum 10 percent of the turnover or an obligation to compensate consumers for the losses sustained. Additionally, President of UOKiK does not exclude any further steps against Eleven Sports in connection with a capacity to mislead football fans. The analysis of the collected evidence, including consumer complaints pertaining to this matter, is pending as part of the preliminary investigation.
