The President of UOKiK, Tomasz Chróstny, deemed PKO BP’s clauses regarding changes to consumer loan interest rates to be unlawful, prohibited their use, and imposed a fine of nearly PLN 80 million on the bank. The bank is also required to inform consumers of the decision individually and publish a statement on its website and social media.

The President of UOKiK brought charges against two lending companies and an intermediary. The practices in question concern the offering of additional, paid services in packages with consumer credit agreements.

In accordance with the Act on Consumer Loan, an early loan repayment equals a return of a portion of commission and some other fees. The President of UOKiK has issued a decision for Profi Credit Polska which obstructed or even prevented its customers from exercising this right.

President of UOKiK Tomasz Chróstny launched a preliminary investigation to determine whether competition in the banking sector may have been restricted. UOKiK is reviewing the rules for assessing consumer creditworthiness and their impact on lending conditions.

More than PLN 10 million has been imposed by President of UOKiK on seven lenders and consumer loan brokers.
